CUEVAS DE LOS GOLONDRINAS is a hidden gem. A bit tricky to find it, but well worth indeed. The beach is difficult to walk on. But the cave with the Swallows is incredible.

DRNA ordena demoler estructura en cueva Las Golondrinas en Aguadilla – WAPA.tv – Noticias
La secretaria interina de Recursos Naturales y Ambientales, Anaís Rodríguez Vega, ordenó hoy la demolición de las estructuras construidas ilegalmente sobre la cueva Las Golondrinas, en Aguadilla, y ordenó la restauración del lugar a las condiciones naturales en que se encontraba antes de ser impactado por esa actividad.
La Resolución y Orden 22-116 emitida va dirigida contra Carlos R. Román González como agente residente de la corporación Aguadilla Pier Corp. La demolición debe hacerse en un término no mayor de 30 días. Igualmente, se ordenó al querellado que solicite los permisos necesarios para realizar la demolición.
Según la Resolución y Orden de Rodríguez Vega, la construcción de las edificaciones se realizó sobre la cueva Las Golondrinas y en la zona marítimo terrestre, resultando en un aprovechamiento de bienes de dominio público marítimo-terrestre, y no cuentan con los permisos o concesiones necesarias del DRNA.
Los pasados 29 de abril y 2 de mayo de 2022 el DRNA inspeccionó el lugar y determinó que existen riesgos relacionados con la construcción de las estructuras sobre la cueva marina, cerca del llamado Muelle de Azúcar. También constató que no hay récord de estudios geofísicos que establezcan que el área es estable y que la construcción era viable. A su vez, la construcción implica riesgos para la integridad de la franja costera en la que ubica.
Por otro lado, la ausencia de buenas prácticas en las actividades de extracción y depósito de relleno han provocado transporte de rocas y sedimentación hacia la zona marítimo-terrestre (ZMT).
El DRNA determinó violaciones a la Ley Núm. 111 de 12 de julio de 1985 (Ley para la Protección y Conservación de Cuevas, Cavernas o Sumideros), Ley de Puertos para la Isla de Puerto Rico de 5 de febrero de 1886, Ley Núm. 23 de 20 de junio de 1972 (Ley orgánica del DRNA), según enmendada, y el Reglamento 4860 (Aprovechamiento, Vigilancia, Conservación y Administración de las Aguas Territoriales, los Terrenos Sumergidos Bajo Estas y la Zona Marítimo Terrestre).
De entender el Querellado que cuenta con los permisos necesarios para las edificaciones en controversia, se le ordenó que -según establece la Ley de Procedimiento Administrativo Uniforme (LPAU)- en un término no mayor de 10 días calendario, a partir de hoy, cuando recibió la Resolución, muestre causa por lo cual deba dejarse sin efecto la orden de demolición de las estructuras construidas sobre la cueva Las Golondrinas.
También tiene derecho, a tenor con LPAU, a solicitar reconsideración de la misma dentro del término de 20 días a partir del archivo de la notificación de la Resolución y Orden. Asimismo, ateniéndose a los términos que establece la ley, le cobijan otros derechos de igual protección de las leyes y acudir al Tribunal de Apelaciones mediante Recurso de Revisión.
“Debe quedar claro que desde que asumí el cargo de secretaria interina, el 1ro de abril, me he ocupado de implantar con todo el vigor posible y los recursos disponibles, como me ha requerido el Gobernador Pierluisi, la política pública ambiental del Gobierno de Puerto Rico. Como he dicho antes, en el DRNA vamos a poner todo nuestro empeño en evitar cualquier violación a las leyes y reglamentos ambientales. No hay violación ambiental pequeña, todas impactan y debemos detenerlas. Los recursos naturales protegidos son del pueblo de Puerto Rico, y el gobierno, junto con nuestro pueblo, podemos protegerlos y conservarlos”, sostuvo la titular de las agencias ambientales.
“Las leyes protegen nuestros recursos y es esa vía legal la que debemos utilizar para detener definitivamente cualquier violación ambiental”, concluyó Rodríguez Vega.
