In 2018, US President Donald Trump was interested in trading Puerto Rico for Greenland, former Department of Homeland Security official Miles Taylor told MSNBC.
This happened during the president’s business trip while Puerto Rico was recovering from the devastating 2017 hurricane. “He told us <...> that he wanted to know if we could trade Puerto Rico for Greenland because, according to him, Puerto Rico was dirty and the people were poor,” Taylor said.
Answering the presenter’s question, he explained that he didn’t take what the President said as a joke.

In August 2019, The Wall Street Journal reported that Trump was considering buying Greenland, which is part of Denmark, and asked a White House lawyer to look into the possibility. According to the sources of the publication, some of the advisers became interested in the idea of buying the island, while the other part considered it a fleeting hobby of the president.

The press service of the government of Greenland told RBC that the island is not for sale, but is ready for negotiations on cooperation with other countries, including the United States.
In July 2020, the former acting Secretary of Homeland Security Elaine Duke said that Trump offered to sell Puerto Rico or get rid of it. According to her, this idea was not taken seriously in Trump’s circle and was not discussed after the president voiced it.
Puerto Rico is a US dependency that is administered but not an integral part of the US. In the fall of 2017, Hurricane Maria wreaked havoc in Puerto Rico, killing more than 60 people.
After the hurricane, during the aftermath, there was a conflict between Trump and the leadership of Puerto Rico. The mayor of San Juan, the largest city on the island, Carmen Cruz accused Washington of insufficiently intensive assistance, and also stated that Trump turned the disaster into a political debate. The President, in turn, argued that the authorities of Puerto Rico want everything to be done for them.

Puerto Rico International Commercial Arbitration was modernized in 2012 when Puerto Rico finally amended the International Commercial Arbitration Law with the hope of becoming an attractive venue for companies and arbitrations and therefore , make the most of its strategic location. Previous Arbitration Law dated 19The 1950s has not been adapted to modern commercial arbitration.
By enacting a law based on the UNCITRAL Model Law, as amended in 2006, Puerto Rico provided a new framework for international commercial arbitration in addition to the Federal Arbitration Act and the New York Convention of 1958. Known as “ International Commercial arbitration law in Puerto Rico” , the new law contains all the key features of modern arbitration law, including the principle of severability of the arbitration agreement or the principle of competence-competence.
Arbitration agreement
Puerto Rico international commercial arbitration law is silent on any formal requirements for arbitration agreements.
Arbitration Court
9002 arbitration proceedings. (Articles 6.02-03). likewise, the parties may choose their own arbitrators. In the absence of such a choice, the default number will be three arbitrators (Articles 3.01-02).
Arbitrators must disclose any information that may give rise to any reasonable doubt as to their impartiality and independence. Otherwise, the parties may challenge the members of the tribunal (Article 3.03).
Under the 2012 law, arbitrators may make awards in their own jurisdiction (Article 4.01).
Provisional measures
Under certain conditions, arbitral tribunals may take provisional measures to maintain or restore the status quo pending resolution of the dispute; prevent actions harmful to the proceedings; and preserve assets or evidence relevant and material to the resolution of a dispute (Article 5. 01).
Applicable law
Likewise, the parties may choose the law applicable to the merits of the dispute. Where the parties have not made such a choice, the arbitral tribunal will determine the applicable law on the basis of the conflict of laws rules it deems applicable.
The arbitrators may also decide the case , as well as for the benefit of or as a friendly composer if the parties have expressly authorized them to do so. The law also requires arbitral tribunals to take into account the use of trade applied to the contract. (Article 7.01).
Correction and interpretation of arbitral awards in Puerto Rico
Following the issuance of an award, the parties, or the arbitral tribunal on its own initiative, may seek the correction of an award within thirty days.
also, parties may request an interpretation of the award or an additional award as to claims presented but omitted from the award from the arbitrators. The parties shall submit such request within thirty days of receipt of the decision. (Article 7.06).
Application to set aside an award in Puerto Rico
The awarded party has three months to seek the annulment of the award. The law establishes a limited number of grounds for the annulment of an award as follows (Section 8.01):
- Incapacity one of the parties or an invalid arbitration agreement;
- Incorrect notice of appointment of arbitrator or arbitration;
- Dispute not subject to arbitration;
- Incorrect constitution of the arbitral tribunal or improper procedure;
- The subject matter is not subject to jurisdiction in Puerto Rico;
- This award is against public policy in Puerto Rico.
Recognition and Enforcement of an Arbitral Award in Puerto Rico
Finally, a party may challenge the recognition and enforcement of an award on the same grounds as for annulment (Article 9.00) in Puerto Rico.
