Arrival/Departure Forms: I-94 and I-94W

Foreign visitors to the U.S. no longer need to complete paper Customs and Border Protection Form I-94 Arrival/Departure Record or Form I-94W Nonimmigrant Visa Waiver Arrival/Departure Record. Those who need to prove their legal-visitor status—to employers, schools/universities or government agencies—can access their CBP arrival/departure record information online. CBP now gathers travelers’ arrival/departure information automatically from their electronic travel records.

Now at the land border, travelers will be issued I-94s electronically and will no longer receive a paper I-94 stub. CBP encourages travelers requiring an I-94 to use the CBP One™ mobile app or the CBP I-94 website to apply for their I-94. For Visa Waiver Program (VWP) travelers, an approved Electronic System for Travel Authorization (ESTA) is now required for entry and must be obtained prior to arriving at the U.S. land border. VWP travelers are encouraged to use the I-94 website or CBP One™ mobile app to apply for an I-94 in advance.

If a traveler would like a paper Form I-94, the traveler can print their own I-94 Form from the I-94 website using “Get Most Recent I-94” or by using the same option on the CBP One™ mobile application. A paper form can be requested during the inspection process but all such requests will be accommodated in a secondary setting.

If travelers need the information from their Form I-94 admission record to verify immigration status or employment authorization, they are encouraged to get their I-94 Number from the I-94 website or by using the CBP One™ mobile app. Upon exiting the U.S., travelers issued a paper Form I-94 should surrender it to the commercial carrier, Canadian Border Services Agency (CBSA), or to CBP upon departure. If you received an electronic I-94 upon arrival by air or sea or land and depart via land, your departure may not be recorded accurately. A departure will be recorded if you depart via land and re-enter the United States prior to the expiration date stamped in your passport. If you are not a resident of Canada or Mexico and you receive an electronic I-94 and depart via land but do not re-enter the United States prior to the expiration date stamped on your passport, you may want to travel with evidence of your departure into Canada or Mexico. Evidence of departure can include, but is not limited to, entry stamps in a passport, transportation tickets, pay stubs and/or other receipts. A traveler can request an entry stamp from CBSA when entering Canada or from the Instituto Nacional de Migracion (INM) when entering Mexico.

Otherwise, when leaving via air or sea, CBP will record the departure electronically via manifest information provided by the carrier or by CBP.

This automation streamlines the entry process for travelers, facilitates security and reduces federal costs. CBP estimates that the automated process will save the agency $15.5 million a year.

Beginning in May 2019, I-94 numbers will be alphanumeric. Currently, I-94 numbers are 11 digits long and only contain numbers. In order to minimize program impact resulting from the depletion of numeric-only I-94 numbers and to create a long-term solution for the creation of new numbers, CBP is switching to alphanumeric I-94s. I-94 numbers will remain at 11 characters but will follow the format of 9 digits, followed by a letter in the 10th position, and a digit in the 11th position. Unexpired I-94s issued in the current numeric-only format will continue to be valid until the Admit Until Date printed on the paper I-94 and/or the date displayed on the I-94 website.

When you travel to the U.S., keep your DS-2019 Form, DS-7002 training plan, and passport with your J-1 Visa in your carry-on luggage.

During your flight, an attendant will give you a Customs Declaration Form (Form CF-6059B) to complete before the end of your flight.

Upon arriving in the U.S., you will immediately go to Customs and Border Protection (CBP) to request admission to the U.S. To facilitate your entry, please tell the CBP official that you are a J-1 Exchange Visitor and present the following documents for inspection:

  • Your valid passport, including your J-1 Visa
  • Form DS-2019
  • Customs Declaration Form CF-6059B

At the border, you will be entered into a United States Citizenship and Immigration Services (USCIS) database, and you may also be fingerprinted and photographed. To learn more about U.S. arrival procedures, visit the Customs and Border Patrol website.

Once CBP’s inspection is complete, the officer will stamp your passport with the date of admission, class of admission, and the time frame you are authorized to stay in the U.S. The officer should write the letters “D/S” as the time frame; this means duration of status. The duration of status includes the program dates listed on your DS-2019 Form, plus 30 days of travel/personal time immediately after your program end date. Though rare, the officer may write an actual date instead of D/S. If this happens, this is the date by which you are required to leave the U.S.

Note: If the date is before your program end date, you must end your program early and leave the U.S. by this date. Notify InterExchange immediately if this occurs.

If you are coming to the U.S. by air or sea, your arrival record will be recorded electronically by Customs & Border Protection.

You will need a copy of this record when applying for important documents like your Social Security number or other forms of identification in the U.S. To access your electronic I-94 record, visit the CPB’s I-94 website. You will choose “Get Most Recent I-94.”

Visitors coming to the U.S. through a land border (most common with Canadian or Mexican participants) will receive a paper I-94 record from the CBP officer at the port of entry. Keep this safe throughout your program, as you will need to turn this in when you depart the U. S. Failure to do so could make future border crossings more difficult, so it is important not to lose this card.

It is rare for J-1 Visa holders to encounter difficulties when crossing the U.S. border. However, if you are agitated, act suspiciously, or if you are missing any documents, CBP officials may subject you to further questioning. If you do not have your DS-2019 Form available, you may be detained; you could also be flagged in the computer system, thus causing delays on future trips to the U.S.

The best way to ensure a smooth entry is to have all necessary forms completed and ready to present to CBP, be friendly and patient in line and with the CBP official, and answer their questions honestly. Although you are not permitted to intern or train before your program start date on your DS-2019, you are permitted to arrive in the U. S. up to 30 days prior to your start date to allow time for you to get settled-in before you begin interning.

Once you’ve arrived in the U.S., you must contact InterExchange within 10 days to register with SEVIS.

The USA is a popular destination for travelers, tourists and business travelers. Foreign visitors usually require a visa to enter the country, but for travelers from 39 countries, there is an alternative way to obtain permission to enter the United States through the Visa Waiver Program. These travelers can apply for an ESTA, which makes them eligible to enter the United States. But what is ESTA?

WHAT IS ELECTRONIC TRAVEL AUTHORIZATION SYSTEM?

ESTA or Electronic System for Travel Authorization is a streamlined online application process for travelers from selected countries that have an agreement with the United States. There are currently 39 countries participating in the VWP program and this number has changed over time. Instead of going through the stressful visa process, you can get your ESTA approved fairly quickly. Who needs ESTA? Individuals from countries participating in the VWP program must obtain an entry permit before boarding an aircraft or ship to the United States.

The Department of Homeland Security is the administrative agency that regulates the issuance of ESTAs under the VWP. The countries included in the program have passed the partnership stage with the US administration and have a low level of risk assessment. Obtaining an ESTA, however, does not mean automatic admission to the country. Travelers are currently required to check government pages on eligibility to enter due to regulations and the status of COVID-19. This information is updated weekly but may change from day to day.

HOW DOES THE APPLICATION PROCESS LOOK?

Who needs an ESTA? Travelers planning to travel to the US must complete an ESTA form, but before visiting the ESTA page, you should check to see if you meet the required criteria. For example, the purpose of your trip must be personal, transit or business, which does not include looking for a job.

Your visit must be limited to 90 days and you must not apply if you already have a valid US visa. Before you start answering the detailed ESTA questionnaire, you must know all the information, which must be in English. Each traveler will be required to complete a separate ESTA application.

It is best to apply for an ESTA no later than 72 hours before boarding a plane or ship in the US. However, the normal processing time for the US administration is three business days, so you should not purchase a plane ticket until your application has been approved.

If you have an urgent need to fly and your flight is less than 72 hours away, there is a chance that US Customs and Border Protection will review your application before the deadline. In this case, you should check your ESTA status online to see if you have been approved.

You will need your ESTA application number to check the status of your application. This is your unique non-transferable number. Your passport number and personal information are also required to log into your account.

WHAT DO YOU NEED TO APPLY?

Let’s first understand what is ESTA? The ESTA application is a very detailed online form. In addition to basic personal data, you will have to provide information about the place of work, travel information and answer a number of clarifying questions. You will also have to provide social media information, which was optional until 2020. This information is now mandatory. If you do not provide social media information, but you have had an active account within the past five years, your application will be denied.

After you complete your application, the US administration will review it. What databases does ESTA check? The customs and border control service will check various databases around the world. The Terrorist Verification Database is one of the main points of verification. The administration will review the information repositories of the Department of Health and the Centers for Disease Control and Prevention. Stolen and lost passports are also checked, as is the ESTA database, looking for applicants who have been denied. CBP will check, in particular, expedited removal and revocation of visas.

DIFFERENCE BETWEEN VISA AND ESTA

There are three categories of countries. The first category includes five countries that are exempt from visa programs. The second category includes countries included in the Visa Waiver Program that can visit the United States through ESTA, and the third includes all other countries. They need a standard US visa.

You can get an ESTA through an online application, but you need to visit a US embassy and make an appointment to get a US visa. A standard visa has several purposes. For example, you can apply for work, study, or other types of visas. On the other hand, you can request an ESTA if you are visiting a country for tourism, business or transit purposes.

PASSPORT RESTRICTIONS

Not all travelers can apply for an ESTA. There are strict passport requirements for VWP. All passport documents that meet the requirements must have a digital chip with biometric information about the person. In addition, the biographical page of the passport must have a machine readable zone.

As of 2016, all ESTA visitors must use an ePassport with the aforementioned electronic chip. It will help if you also have a digital photo, i.e. the photo is printed and not pasted on the bio page.

General Information

Each applicant, including children, must submit a separate visa application on Form DS-160. Form DS-160 is completed and submitted online prior to the interview at the embassy. To make an appointment for an interview, you must provide the barcode number that is indicated on the confirmation page of the DS-160 form. The DS-160 application must be submitted online. The US Embassy does not accept handwritten or typewritten applications. No interview will be held without submitting a DS-160 confirmation page.

By electronically signing Form DS-160, the applicant certifies that the information provided on the application is true and correct. Misrepresentation of the information provided may result in a ban on entry into the United States. Carefully check the accuracy of the answers to all questions.

Guidelines for Completing Form DS-160

Complete and submit Form DS-160 after reviewing the nonimmigrant visa application process. Form DS-160 must be submitted online prior to scheduling an interview at the US Embassy.

  • The location of the interview you choose at the beginning of the DS-160 must be the same as the location where you are scheduled for the interview.
  • All questions must be answered in English, using the English alphabet only, except for the item in which your last name and full name must be written in the alphabet of your native language.
  • When applying on Form DS-160, you will need to upload a photo of yourself taken within the last six months. Detailed recommendations for obtaining high-quality images and their transmission can be viewed on the website of the US State Department by clicking on this link.
  • If there is no user activity, the DS-160 form will time out after 20 minutes. To avoid having to start filling out the form from the beginning, write down your application ID number or download the application file to your computer. Write down the Application ID number that appears in the upper right corner of the page. If you need to close your browser before submitting your application, you will need this ID number when you wish to continue completing your application.
  • Completing Form DS-160 generates a confirmation page with an alphanumeric barcode. Print this page. A printed confirmation page is required to book an interview and during an interview at the US Embassy.
  • After printing a confirmation page with a barcode, click “Back” in the browser window and send a copy of Form DS-160 to your email address. The submitted file has a PDF extension and requires Adobe Acrobat to view or print.
  • A new online visa application form (DS-160) for a non-immigrant visa, with the corresponding barcode, must be provided by each applicant with each new visa application. The DS-160 visa application form and the barcode provided at the previous interview or in the previously sent documents will not be accepted and the consideration of the visa case may be delayed.
